JIOMART PARTNER E-WASTE RECYCLING POLICY
1. INTRODUCTIONThe information and communication revolution has brought enormous changes in the way we organize our lives, our economies, industries and institutions. These spectacular developments in modern times have undoubtedly enhanced the quality of our lives, but at the same time, have led to manifold problems including the problem of massive amount of hazardous waste and other waste generated from electric products. Such waste poses a serious threat to human health and environment. The issue of proper management of such hazardous E-Waste is therefore critical to the protection of livelihood, health and environment.
To deal with this ever-rising problem of E-Waste, the government of India, through its Ministry of Environment and forest, formulated the E-Waste (Management and Handling) Rules in 2011 (“ Regulations”).
This E-Waste Policy (defined hereinafter) an agreement between Reliance Retail Limited, (“Reliance”, “we”, “us” or “our”) which operates the mobile application/website www.jiomarpartners.com, (collectively referred to as the “JioMart Partner Platform”) through which it inter alia facilitates the sale and purchase of diverse range of products listed (“Products”) and you, the user of the JioMart Partner Platform (“User” or “Users” or “you” or “your”).
For the purposes of this policy: (a) “JioMart Partner Platform” means the website www.jiomarpartners.com, which includes its corresponding mobile application or any other digital platforms, applications and/or operating system as provided by Reliance, on which the Partner may avail the Services (defined below) and includes applications controlled and managed by Reliance which interact with one or more such mobile applications/ websites/ tablets and digital modes as provided by Reliance or its affiliates; (b) “Products” shall mean the variety of products offered for sale to you on the JioMart Partner Platform; and (c) Reliance and you are hereinafter individually referred to as “Party” and collectively as “Parties”.
It is clarified that this policy is read in conjunction with the JioMart Partner Terms and Conditions and the JioMart Partner Terms and Conditions are incorporated herein by reference.
2. APPLICABILITYThis E-Waste Recycling Policy (“E-Waste Policy”) is applicable only for Reliance Digital branded products on the JioMart Partner Platform.
3. OBJECTIVEConserve Resources
Creation requires raw resources. But when we recycle, extant material is put to use. Recycling saves this extraction of the fresh raw resources, and revives the existing ones that are no longer of use. This way there is lesser exploitation and more conservation of natural resources.
Save EnergyEach time we recycle a product, it requires lesser energy than producing a new one from the scratch. The considerable difference in manufacturing time is a result of skipping the usual process of extraction of raw material, its transportation, refining etc., which is way more than having a market ready product that to have a raw material ready for production.
Prevent PollutionProduction and disposal of products require a great deal of extraction, refining, processing and dumping of material, which have larger impact on the environment. By recycling, we cut down the pollution of air, water and land, thus reducing the greenhouse gas emission and avoiding any contribution to global warming.
Don'ts for E- Waste- ● The product should not be opened/dismantled by the User himself/herself, but only by authorized service personnel
- ● The product is not meant for re-sale to any unauthorized agencies/scrap dealer
- ● The product is not meant for mixing into household waste stream.
- ● Do not keep any replaced spare part(s) from the product in exposed area

The Basel Convention defines wastes as-
Substances or objects, which are disposed off or are intended to be disposed off, or are required to be disposed off by the provisions of national laws.
E-waste has been defined as-Waste electrical and electronic equipment, whole or in part or rejects from their manufacturing and repair process, which are intended to be discarded.
Whereas, Electrical and electronic equipment has been defined as
"Equipment which is dependent on electrical currents or electro-magnetic fields to fully functional".
Like hazardous waste, the problem of e-waste has become an immediate and long-term concern as its unregulated accumulation and recycling can lead to major environmental problems endangering human health. This calls for an urgent need for E-Waste Management so as to preserve the ecological balance and reduce landfills. Recycling end-of-life products is vital if we are to save resources and minimize waste. In this regard, we at Reliance have tied up with Reteck Envirotech Pvt. Ltd, one of the world's largest authorized E-Waste recycler, for facilitating our Organization and our customers to enable them to dispose E-Waste products after its end-of-life.
As an environmentally conscious organisation, Reliance has initiated various activities to promote e-waste recycling including 100% recycling and disposal through authorized recycler to avoid the adverse effects of E-Waste.
5. ADVERSE EFFECTS OF E-WASTE- ● Toxic material present in e-waste get mixed with earth, air, water, etc and causes health issues.
- ● Oil & Gases which is present in e-waste like compressor and CRT causes environment pollution.
- ● Batteries contains highly hazardous elements.
- ● Burning of rubber & Plastic in open area causes air pollution.
- ● Bad impact on human being, animal, and other animates.
- ● Wastage of natural resources.
“Authorised Recycler” means any recycler, waste dismantler or other entity chosen by Reliance for the management of e-waste under this E-Waste Policy.
- ● All electrical and electronic products are required to be handed over only to the Authorized Recycler for recycling by the Partner.
- ● The E-Waste product should be handed over only to an Authorized Recycler for disposal.
- ● Keep the e-waste in isolated area, after it becomes non-functional/un-repairable so as to prevent its accidental breakage.

7. AMENDMENT AND CONFLICTAny subsequent amendment/modification in the applicable laws shall automatically apply to this E-Waste Policy. Reliance has the right to amend or modify this E-Waste Policy in whole or in part, at any time without assigning any reason, whatsoever. In the event of conflict between this E-Waste Policy and any applicable laws, applicable laws shall prevail.
8. NO LIABILITYReliance shall, in no manner, be liable for any non-compliance with this E-Waste Policy and/or the Regulations by the Partner. You agree to indemnify, defend and hold harmless Reliance, its affiliates, officers, directors, employees, consultants, licensors, agents, and representatives from and against any actions but not limited to fraudulent transactions, any and all third- party claims, losses, liabilities, damages, abuse and/or costs (including reasonable attorney fees and costs) arising from your non-compliance with this E-Waste Policy and/or the Regulations. Reliance will notify you promptly of any such claim, loss, liability, or demand, and in addition to the foregoing, you agree to provide Reliance with reasonable assistance, at their expense, in defending any such claim, loss, liability, damage, or cost.
9. GOVERNING LAW AND DISPUTE RESOLUTIONReliance and you shall endeavour to amicably, through discussions, settle and resolve any dispute or difference arising out of or in relation to this E-Waste Policy (“Dispute”) within 15 (fifteen) days from the commencement of such Dispute. In case of such failure, the Dispute shall upon the expiry of the aforesaid period, be referred to e-arbitration to be conducted by a sole arbitrator, who shall be jointly appointed by Reliance and You from the panel of available e-arbitrators. All arbitration proceedings may be conducted through mode available on the internet or any other information and communication technology (including but not limited to video call system, telephone or mobile, fax, e-mail facilities) which can be beneficially used to solve disputes. All Arbitration proceedings shall be held in accordance to the provisions of Arbitration and Conciliation Act, 1996. The language of Arbitration shall be English. The arbitral award shall be final and binding on Reliance and you. The award may include costs, including reasonable advocates’ fees and disbursements.
This E-Waste Policy, and the relationship between Reliance and you is governed by the laws of India, without reference to any conflict of laws principles and with an exclusive jurisdiction to the courts of Mumbai.
10. RIGHT TO AUDIT AND / OR EXAMINE RECORDSReliance may, on its own, or by engaging a third-party auditor (“Auditor”) at Reliance’s expense, and, upon Reliance’s request thereof, examine any of your records, invoices and/or other data or documents that are necessary to establish your compliance or non-compliance with this E-Waste Policy.
